條款及細則 UK Home Square / UK Home Limited (以下簡稱UKHS) A. 個人資料 1. 所遞交之表格及有關費用將不予以退還。 2. 學員必須提供足夠的個人資料，而該資料須正確無誤。 3. 根據，學員有權查閱及更改其個人資料，如有需要，可書面通知 UKHS 。 4. 學員所提供的個人資料，用作UKHS處理課堂安排，並保密所有資料。 5. 學員明白在此申請表所填報之資料將用作處理以下各項: 5.1 學員之申請，有關資料將於報名成功後保存為學生個人檔案之一部份； 5.2 提供予UKHS，作行政、傳訊及其他相關之用途；及 5.3 推廣與UKHS有關，包括但不限於課程、活動、專享優惠與及其他服務。 B. 課堂安排 1. 已報讀的課程及遞交的款項將不設退款。 2. 如學員要更改上課日期，可以更改至下一期課程上堂，並只接受一次更改，學員需要開課前不少於5個工作日書面通知UKHS，行政費用為每位HKD100。 3. 課程通過視像會議軟件Zoom網上舉行。 4. UKHS保留更改課程時間、上課地點、上課模式及課程內容之權利。如有任何有關課程時間之特別安排，將另行通知。 C. 學員需知 1. 上課期間，請勿拍攝、錄音或錄影，如有發現，UKHS有權取消其學員資格，不會退還已繳交費用，以及保留追究權利。 2. UKHS的課程內容包括但不限於「合作機構」律師、會計師、稅務師、測量師、物業代理、按揭代理、租務代理、保險代理、裝修建築團隊等的聯絡資料為保密資料，只供學員參考及閱讀，而擁有權及版權歸UKHS所有，學員未經准許，不得擅自公開有關課程內容。如對UKHS造成任何損失，UKHS保留追究權利，學員需向UKHS作出彌償。 3. 學員不能將 UKHS的課程內容用作商業用途，如對UKHS造成任何損失，UKHS保留追究權利，學員需向UKHS作出彌償。 4. UKHS 保留隨時修改條款及細則並終止此促銷活動的權利，恕不另行通知學員。 UKHS 對任何此類更改或終止不承擔任何責任。 D. 免責聲明 1. 學員因個人原因而無法上課，UKHS對此將不承擔任何責任，不作任何退款或更改日期。 2. UKHS及其代表不會提供任何投資意見，本課程及分享純粹用作學術用途，資料僅供參考，其內容不能視為向任何人士推薦英國物業投資提供意見，亦不構成任何投資產品之要約、要約招攬或建議。 3. 學員務須清楚明白買賣英國物業的風險，並非每位學員均適合買賣英國物業，學員可能有財務上的部份或全部損失。在做出任何投資決定之前，學員需要進行獨立研究分析及諮詢專業人士意見。 4. UKHS及其代表不是任何專業人士，並沒有持有任何專業資格及相關牌照，例如包括但不限於律師、會計師、稅務師、測量師、物業代理、按揭代理、租務代理、保險代理、裝修、維修、建築等等， 其課程內容及分享均屬個人心得及經驗分享，投資或買賣英國物業之前，學員需諮詢相關專業人士之意見。 5. UKHS及其代表可能處理香港以外地方的物業，故無需按香港之《地產代理條例》領取牌照及並無處理位於香港的任何物業的牌照。 6. UKHS及其代表不會承擔學員買賣英國物業及相關活動之法律及財務責任，包括但不限於UKHS及其代表可能介紹處理英國物業的 “合作機構” 與學員之間的任何法律及財務責任。 7. UKHS及其代表不保證“合作機構”的服務質量。 8. UKHS及其代表可能收取“合作機構”費用，或可能付費用給“合作機構”。 9. UKHS及其代表不能保證課程及分享內容資料絕對正確。UKHS及其代表不會對任何資料不準確、錯誤或遺漏所引起學員之損失負上法律及財務責任。所有錯漏亦不可作為任何申索或訴訟之根據。 10. 如有任何爭議，UKHS保留最終解釋及決定權。 UKHS 保留不時更新上述所有條款及細則的權利，恕不另行通知學員。 最新版本的條款及細則可以在 https://www.ukhomesquare.com上瀏覽。 TERMS OF USE AND SERVICE – UKHS UK FORUM / PLATFORM 1. General 1.1. If you browse or otherwise access any content or data on ukhomesquare.com and/or instant messaging groups (including its website, mobile site, any subdomains of those websites, mobile sites, applications, telegram, whatsapp or instant messaging applications) (collectively “UKHS Forum / platform”), you agree to be bound by these Terms of Use and Service (“Terms of Use”). Contributions 4.1. UKHS may at any time, without liability to you, remove, alter or disable access to any or all of your Contributions in its sole discretion without prior notice to you. Without limiting the previous sentence, UKHS may remove or disable access to any or all your Contributions if it considers that: 4.2.1. those Contributions are in breach of any law or regulation; 4.2.2. those Contributions infringe or are likely to infringe upon the intellectual property rights of any third party; 4.2.3. it is required to do so by a regulatory body or any relevant authority pursuant to an interim or final take-down notice; 4.2.4. those Contributions are (i) misleading or deceptive, (ii) inappropriate having regard to the purpose of our forum / platform, (iii) likely to cause offence, (iv) materially incorrect, (v) obscene, (vi) derogatory or defamatory, (vii) otherwise in breach of any applicable laws, or (viii) corrupted, due to the presence of a virus or other disabling code. 4.3. To the extent that any Contributions are proprietary in nature, you grant UKHS a worldwide, nonexclusive, royalty-free, perpetual, transferable and irrevocable licence to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and display and publicly perform your Contributions throughout the world in any medium, whether currently in existence or not. You also grant each user of our forum / platform a non-exclusive licence to use, reproduce, adapt, translate, distribute, prepare derivative works of, display and perform your Contributions as permitted by UKHS and these terms. 4.5. You grant UKHS, in respect of Contributions to its website the right to use your name or the name you submit with the Contribution, and, the right to represent and warrant that: 4.5.1. you own and control all of the rights to the Contributions; or 4.5.2. you have the lawful right including all necessary licences, rights, consents, and permissions to use and authorise UKHS to display the Contributions. 4.6. For any Contributions that you may retain moral rights in, you declare that: 4.6.1. you do not require that any personally identifying information be used in connection with the Contribution, or any derivative work, upgrade or update of the Contribution; and 4.6.2. you understand that when accessing our forum / platform, you may be exposed to the Contributions of other users of our forum / platform. You acknowledge and agree that UKHS does not have control of and is not responsible for these other Contributions. You agree to hold harmless and release UKHS from any and all claims that you could assert against UKHS relating to or in connection with these other Contributions. 4.7. You represent and warrant that: 4.7.1. you have the lawful right including all necessary licences, rights, consents, and permissions to use and authorise UKHS to display your Contributions; and 4.7.2. you will not make any Contributions that (i) infringe the intellectual property rights of any third party, and you agree to pay all royalties, fees or other monies payable by reason of any Contributions made by you, (ii) are misleading or deceptive, (iii) are materially incorrect, (iv) are likely to cause offence, (v) directly or indirectly involve the advertising or marketing of any products or services, (vi) are obscene, including pornographic, hateful, racially or ethnically offensive material, (vii) are derogatory or defamatory, (viii) are in breach of any applicable laws, or (ix) are otherwise unlawful or encourage unlawful conduct; or are otherwise inappropriate having regard to the purpose of our forum / platform. 4.8 You agree to indemnify and hold UKHS or its affiliates, directors, officers or employees harmless of any and all loss, liability, claim or demand (including reasonable attorneys’ fees) arising out of, or in connection with any breach by you of this Section. 5. Third Party Content 5.1 The UKHS Forum / platform contains content provided to UKHS by other parties (“Third Party Content”). UKHS does not warrant and you acknowledge and accept that we do not pre-approve, pre-screen, monitor or making inquiries about all Third Party Content. UKHS is not responsible for, does not endorse and makes no representations nor warranties either expressly or impliedly concerning the quality, accuracy, completeness, timeliness, reliability or non-infringing nature of any Third Party Content. Third Party Content does not represent the views of UKHS. You rely on Third Party Content completely at your own risk. 5.2 Third party links and advertising. The UKHS Forum / platform often includes advertisements, hyperlinks and pointers to websites operated by third parties. Links to third party websites include, without limitation, links on our forum / platform to some of the partners and real estate agents in the UK that UKHS collaborates with. Those third party websites do not form part of our forum / platform and are not under the control of or the responsibility of UKHS and UKHS makes no representations or warranties with respect to, nor does UKHS guarantee or endorse the quality, accuracy, completeness, timeliness, reliability or non-infringing nature of such third party website, materials, information, products and services you may access from wuch third party websites. When you link to those websites you leave the UKHS Forum / platform and do so entirely at your own risk. Your correspondence and/or any other dealings with such third parties are solely between you and such third parties. UKHS and its related entities make no warranty as to the accuracy or reliability of the information contained on any third party websites, and UKHS and its affiliates, directors, officers and agents expressly disclaim all liability and responsibility for any and all Third Party Content or any and all third party provided information, materials, programs, products and/or services covered or accessible through either UKHS or third party websites. You expressly agree that UKHS shall not be responsible or liable for any direct or indirect loss or damage which may be suffered by you through relying on anything contained on or omitted from such third party websites. If you request a property or suburb report or price estimate (“Property Report”) via the UKHS Forum / platform (subject to availability on the UKHS Forum / platform), you consent to the use of your email address for the purposes described in our Privacy Policy. Property Reports are of a general nature only, based on historical data and will not take into account the potential impact of external factors (including but not limited to changes in the economy, future planned infrastructure, regulation, environment or the property market) which may affect the value of the property. Termination 11.1. We may, under certain circumstances and without prior notice, at our sole discretion immediately terminate your account (if any). Cause for such termination shall include without limitation: 11.1.1. breaches or violations of the Terms of Use, Policy of Acceptable Use, or other incorporated documents, guidelines or rules; 11.1.2. request by law enforcement or other government agencies; 11.1.3. self-initiated account deletions; 11.1.4. infringement of intellectual property rights of others; 11.1.5. discontinuance or material modification to the services on the UKHS Forum / platform, or part thereof; 11.1.6. unexpected technical or security issues or problems; or 11.1.7. extended periods of inactivity. 11.2. Termination of your account shall result in: 11.2.1. removal of access to and barring of further use to all offerings of the UKHS Forum / platform that are associated with such account; and 11.2.2. deletion of your password and all related information, files and content associated with or inside your account (or part thereof). 11.3. Termination of your account shall be without prejudice to any other rights or remedies we may be entitled to under the Terms of Use, at law or in equity and shall not affect any accrued rights or liabilities nor the coming into or continuance in force of any provision which is expressly or by implication intended to come into or continue in force on or after such termination. 12. Any consent given by us shall operate as a consent only for the particular matter to which it relates and shall in no way be considered as a waiver or release of any of the provisions in these Terms of Use. 13.3. The provisions of these Terms of Use shall be enforceable independently of each other and the validity of each provision shall not be affected if any of the others is invalid. In the event any provision of these Terms of Use is determined to be illegal, invalid or unenforceable, the validity and enforceability of the remaining provisions of these Terms of Use shall not be affected and, in lieu of such illegal, invalid, or unenforceable provision, there shall be added as part of these Terms of Use one or more provisions as similar in terms as may be legal, valid and enforceable under the applicable law. 13.4.
